Sales Agreement

USER SALES AGREEMENT

1-) SUBJECT:

The subject of this agreement includes the rights and obligations of the parties related to the performance of travel services sold to the Customer.

2-) PRICE AND PAYMENT TERMS

The total price of the services provided includes all taxes.
This amount can be paid according to the payment method determined by the service provider (the accommodation, flight, transfer or tour provider) as follows:
1. At the time of reservation by credit card or
2. By EFT/Transfer to the specified bank accounts
3. Can be paid at the time of the relevant accommodation or transportation service.
Payments will be clearly indicated in the shopping cart with the phrases ‘to be paid now’ and ‘to be paid on-site’ regarding the amounts to be paid immediately or later during the performance of the service as per the agreement.

4-) SERVICE INTRODUCTION INFORMATION:

5-) TRANSFER

The transfer rights in accommodation services are provided according to the rules determined by the service provider; in this case, the customer must inform the situation at least 7 days in advance.

6-) CANCELLATION AND MODIFICATION

The consumer must document any inconveniences and deaths that prevent them or their first-degree relatives from participating in the daily routine of the reservation at a fully equipped state hospital with an official report, except in cases of reasons outside of this. For cancellations made up to 60 days before the start of the trip, all fees paid by the CONSUMER up to that point will be refunded, excluding extra service fees such as transportation and visas.
If the CONSUMER cancels the agreement 59-31 days before the start of the trip, they accept and commit to paying 25% of the trip cost; if they cancel 30-15 days before, they accept and commit to paying 50% of the trip cost; and if they cancel up to 14 days before, they accept and commit to paying the full trip cost to The Erzurum Hotel.

7-) CANCELLATION OF THE HOTEL AGREEMENT:

If The Erzurum Hotel arbitrarily cancels the agreement without valid reasons, the consumer is entitled to compensation for the damages they have incurred. Additionally, The Erzurum Hotel will refund all payments made by the consumer up to that day and all documents that put the consumer in debt within 10 days.
In case of cancellation of the agreement due to force majeure, the consumer’s right to compensation is not valid even if The Erzurum Hotel has shown all necessary care.

😎 NOTIFICATION PERIOD:

The consumer is obligated to notify the service provider and The Erzurum Hotel of any failure to perform the agreement, whether in full or in part, within 7 days from the date the service was supposed to be provided or was provided.

9-) LIABILITY:

The Erzurum Hotel is responsible for non-performance of obligations arising from the agreement. However, if the non-performance of the agreement is due to the fault of the consumer or third parties, or due to force majeure, the hotel cannot be held liable.

10-) FORCE MAJEURE:

The Erzurum Hotel may cancel or delay accommodations due to reasons beyond its control, such as adverse weather conditions, roadblocks, strikes, terrorism, fog, storms, war, the possibility of war, natural disasters, changes and negative developments in intergovernmental relations, public movements, unforeseen technical issues, bankruptcy, and force majeure. In this case, The Erzurum Hotel shall not be liable in any way and the consumer cannot make any claims or demands for rights and receivables.

11-) LUGGAGE :

11.1 Prohibited items include those that have strong odors, are liquid, flammable, or explosive, or items that cause discomfort to others, as well as sharp, piercing, and firearms, and all kinds of animals. Such items are not allowed in transportation vehicles and accommodation facilities without explicit written permission from the hotel.
11.2 In case of loss or damage to luggage due to the heavy fault of The Erzurum Hotel personnel, 50% of the part corresponding to the total cost of the trip for the lost or damaged luggage’s contents will be paid to the owner of the lost items, regardless of material and moral value or other attributes and characteristics. The Erzurum Hotel is responsible for any loss, damage, or theft of the items declared in writing by the consumer along with their values, up to the total cost of the trip.

12-) OTHER TERMS :

If the consumer leaves the hotel due to a defect in the service, they are obliged to inform The Erzurum Hotel in writing, stating the reasons for their departure. Otherwise, the consumer will be considered to have left the hotel and to have accepted and used the service.
It is the duty of the well-intentioned consumer to inform the authorized person in writing of the issues they have complaints about during the performance of the service. If the consumer uses the service until the end despite having complaints, they will waive their rights to compensation such as replacement service and refund related to the issues they complained about.
Consumers who did not sign the contract but participated in the trip subject to the agreement, the consumers they have authorized to register in their name will be considered to have read, accepted, and committed to this agreement. Nevertheless, if the consumer(s) do not have their signatures on the agreement, the hotel reserves the right to reclaim any excess amount paid to the consumer(s) in case the consumer initiates lawsuits and pursuits against the hotel beyond the provisions written in this agreement. Even if consumers have not signed, this agreement will be valid between the parties, as they have learned the terms of this agreement due to catalogs and advertisements and have committed to participate in this agreement’s terms at the hotel.

13-) RESPONSIBILITY:

The customer declares that they have read and understood all preliminary information regarding the qualities of the service mentioned in this agreement, the selling price, payment method, the validity date of the prices, and their fulfillment, and that they have given the necessary confirmation in electronic form.
This agreement will enter into force upon the approval of the Customer, and it is accepted that the date of approval will be considered the effective date. The customer will not be able to advance within the web system without reading and approving this agreement and is obligated to read this agreement. This agreement will terminate in the event of the service being received and consumed by the Customer or if it is subject to cancellation in any way.

14-) COMPETENT COURT :

Erzurum Courts and Enforcement Offices are authorized to resolve disputes arising from this agreement.
The hotel accommodation terms mentioned above, consisting of fourteen items, have been arranged through mutual negotiation between the parties with their free will.
